An affidavit to be Commissioned by the Commissioner of Oaths for Taking Affidavits is regulated by the Commissioner for Taking Affidavits Act, R.S.O 1990 c.C.17.
If the Commissioner and the declarant individual are not in physical presence of each other, the Commissioner may administer the oath or declaration remotely as per regulation 431/20 of the Act, Administering Oath or Declaration Remotely.
Now the practice is that Remote Commissioning is being accepted in court documents and filing.
Before you start the Online Notary process, you need to find out from the recipient organization whether Document Notarized or Commissioned Online is an acceptable form of document.
What is Electronic Signature?
In the normal course of Notarization/ Commissioning of documents, the individual signs a document in the physical presence of the Notary or Commissioner of Oaths. Electronic signature refers to typing your name at the end of your email, digitized handwritten signature, or signature in electronic form on a particular document.
Steps to follow for Remote Commissioning of Documents
- Find out what document is to be Commissioned.
- Find out if the recipient party will accept a remotely commissioned document.
- Forward high-resolution digital images of your two pieces of Government issued photo identifications by way of email Attachment.
- Forward a copy of the Unsigned document in PDF format by Email Attachment.
We will confirm the time of appointment and whether the document could be Commissioned remotely or not.
- Once it is determined that the document can be commissioned remotely, we will send you secure login instructions.
- A video conferencing meeting with the Commissioner for taking affidavits will be scheduled.
- During Video Conferencing you will show your original photo Identifications. We will compare it with the photo identification sent to us earlier.
- Confirm the contents of the affidavit, exhibits and any declaration sent to us.
- You will now have a wet signature on the document.
- You will scan the document and email it by PDF attachment while remaining in video conference.
- We will download and print your document, affix the Commissioner for Taking Affidavit stamp, and have wet signature on the document.
- We will now scan and return it to you by way of email PDF attachment.
- If you require the original signed and sealed document, you can either pick it up from our office or we can mail to you through Canada Post with extra cost or fee.
Which documents we do not Notarize/ Commission online?
As we stated earlier, it is the requirement of the recipient organization whether to accept online notarization/ Commissioning, however, as per our office policy we do not notarize or commission the following documents:
- Wills and Codicils
- Power of Attorney
- Separation, marriage, child custody, adoption agreements and contracts
- Real estate sale and purchase agreements and transaction documents
- Promissory notes and agreements
- Trust agreements and contracts
