Land Title searches could be accomplished from two land registration systems exist in Ontario:
Registry system under Registry Act
Land title system under Land Titles Act
The registry system operates under indexing system based on geographic location. However, Land titles system is based on parcel numbers. The process of searching title under registry system is cumbersome and time consuming since the searches are done through physical registry office and browsing the registers and records. A title search for 40 year period is typically necessary; therefore, searches might have to go behind the plan (book) back to the abstract books that covered the original lot. Ultimately, the chain of title should go back to the original Crown Patent (i.e., the root of title).
In the case of Land Title System searches, the actual searching process involves identifying outstanding entries on the most recent parcel register for a specific property. In the searching process, the certificate of title search is intended to be a complete and accurate reflection of result of all preceding transactions affecting the property and title .
